GENERAL TERMS OF SALE

GENERAL TERMS OF SALE The sale of holidays offered by CHATEL TOUR " Central Reservation Office" is governed by:

==> Act n° 92-645 of 13th July 1992 and its provisions which set out the rules relating to the organisation and sale of travel arrangements or holidays, with respect to the sale of " all-inclusive " holidays, holidays in hotel accommodation and additional services.

==> Act n° 70-9 of 2nd January 1970 and its provisions which set out the rules relating to property management, with respect to so-called seasonal rentals (accommodation only).

A full set of the general terms of sale for these holidays is available on request.

In addition to the general terms of sale, the following specific conditions detailed below also apply.

Signing up for one of the holidays proposed by CHATEL TOUR implies the acceptation of these conditions.

OUR SPECIFIC TERMS OF SALE

" DEPOSIT: The booking will only be considered confirmed on receipt of a deposit equivalent to 25 % of the total cost of the booking.

" BALANCE: FURNISHED ACCOMMODATION INDIVIDUAL: The balance is to be paid when you collect the keys, either to the property owner, or to the representative on site.

HOTELS: The balance is to be paid to CHATEL TOUR not later than 30 days before the date of arrival. "ALL-INCLUSIVE" HOLIDAYS and ADDITIONAL SERVICES: The balance is to paid to CHATEL TOUR not later than 30 days prior to the date of arrival.

" PROPOSED GOODS AND SERVICES: The client expressly acknowledges that he/she has read and understood the nature of the proposed products and holidays, as well as all the information and conditions contained in the brochure, the offer or the booking form, provided prior to booking.In view of the technical difficulties involved in producing brochures and the possible changes that may occur regarding the type and extent of facilities included in the services provided, CHATEL TOUR will do its best to inform the client of any changes no later than on the day of booking.

" RISK PREVENTION PLAN: The commune of Châtel is covered by a natural risk prevention plan. On request, you can obtain a risk report which relates to the building in which the premises for the present rental contract are located.

" LENGTH OF STAY: As a rule, the stays are from SATURDAY to SATURDAY; however at certain times, different periods are possible.

" PRICES: Prices are given in Euros (all taxes included). As CHATEL TOUR acts as a booking agent, some elements such as the amount of the returnable deposit, local tax etc. can vary depending on the accommodation provider or service providers.

" LOCAL TAX: Effective in the resort (conditions detailed in registration form).

" COLLECTING AND RETURNING THE KEYS: The keys are available for collection every Saturday from 4 p.m. The apartments and hotel rooms must be vacated before 10 a.m. the following Saturday. In the event of a late arrival, or defered you must contact the property owner or his representative on site (hotelier, estate agency or individual), to give him the details of your arrival. Any arrival outside of the provided days or times must be made by special agreement. If this is not respected, CHATEL TOUR cannot be held liable.

" CIVIL LIABILITY INSURANCE: CHATEL TOUR has taken out civil liability insurance with AXA Assurance - THONON LES BAINS. " CANCELLATION: If the payments set out in the contract are not received on the due dates, we are legally entitled to cancel the booking.

" INSURANCE: Châtel Tour declines any liability in the event of theft, burglary or fire on the rented premises. The tenant is under obligation is to take out insurance covering rental risks of all kinds caused during his stay and for which he may be held liable. Châtel Tour reserves the right to demand the production of an insurance certificate which covers the rented premises.

" CANCELLATION CONDITIONS AND CANCELLATION INSURANCE: In the event of a cancellation, the client must inform Chatel Tour in writing.

" If the cancellation is made more than 28 days prior to the arrival date: the total amount of the deposit is kept by CHATEL TOUR. " If the cancellation is made between the 28th and the 14th day prior to the arrival date:

=>For a booking for furnished accommodation (accommodation only), the total amount of the deposit is kept by CHATEL TOUR and the tenant is liable to pay the part of the balance corresponding to 50 % of the total amount of the rental cost.

=>For an " all-inclusive " stay, a stay in hotel accommodation and for all additional services: 50% of the amount already paid will be kept by CHATEL TOUR." If the cancellation is made less than 14 days before the arrival date or in the event of a no-show:

=>For a booking for furnished accommodation (including accommodation only), the total amount of the deposit is kept by the accommodation provider and the tenant is liable to pay the balance of the rental cost.

=>For an " all-inclusive " stay, a stay in hotel accommodation and for all additional services: all amounts already paid will be kept by CHATEL TOUR. Please note that unless previously agreed with CHATEL TOUR, any change to the stay, whatever its nature will be considered as a cancellation and will lead to identical costs. CHATEL TOUR offers you the possibility of taking out insurance which covers the cancellation or curtailment of your holiday. We recommend that you take out this insurance which can be done at the time of booking.

" OBJECTIONS, COMPLAINTS and LEGAL DISPUTES: In order to ensure that your stay goes as well as possible, any objections, complaints or legal disputes must be received by our offices, not later than 3 days after your arrival, to enable us to intervene. Only objections, complaints and legal disputes relating to your stay that are received by CHATEL TOUR within this time will be taken into consideration.

" LIABILITY: CHATEL TOUR cannot not under any circumstances be held liable in the event of shortcomings by a contractor (accommodation provider or service provider) during the holiday, or in the event of force majeure, accidents, strikes or due to events caused by any person whose services are not linked to the organisation of the stay. Except in the event of force majeure, CHATEL TOUR will endeavour to replace the faulty services with equivalent ones.

" JURISDICTION: The parties to the present contract give jurisdiction to the Tribunal de Grande Instance in THONON LES BAINS.

SPECIFIC CONDITIONS FOR FURNISHED ACCOMMODATION

" RETURNABLE DEPOSIT: You will be asked for a returnable deposit decided on by the property owner or estate agency. This deposit will be returned after inspection of the apartment and after deduction of possible damage and cleaning costs, if the apartment is not left in a suitable state of cleanliness. If the returnable deposit does not cover the cost of such damage, the tenant agrees to pay the necessary amount to cover the costs.

" THE PRICES DO NOT INCLUDE: Sheets and household linen, (unless otherwise stated in CHATEL TOUR's offer).

" CAPACITY: The apartment's capacity is defined in the contract. In the event of any additional persons, the accommodation provider is within his rights either to ask for a supplement as defined by himself or to refuse the additional person.

SPECIFIC CONDITIONS FOR HOTELS

" PRICES: prices are all-inclusive. They are calculated according to the family make-up given at the time of booking. " Additional services detailed in the booking and not used by the client during his stay must still be paid to the hotelier (unless by special arrangement)
